Charges for Tyson Beckford’s nephew Dominic Whilby have been upgraded to second degree murder after drunkenly running into a bus and killing a MTA driver.
Whilby, 23, was driving in a stolen delivery truck when he ran a red light and struck a MTA bus driven by William Pena, 50, cops said. Pena was ejected from the bus and pronounced dead on the scene. Four others suffered minor injuries at the scene.
“The defendant’s actions, as depraved and as wanton as they were, show that no amount of bail is appropriate for this defendant at this time as he is charged with murder in the second degree and other charges,” Assistant District Attorney Randolph Clarke Jr. said in Manhattan Supreme Court.
Whilby was seen partying with Beckford and Victoria’s Secret model Shanina Shaik at 1OAK nightclub before being escorted out for being too hands on with female club goers. He then wandered through the streets until stumbling upon the box truck owned by a distribution company for 18 Rabbits granola. The keys were inside the vehicle and Whilby sped off hitting a scooter, a coffee stand and two parked cars before striking the bus. He blacked out at the scene and was taken to Bellevue Hospital.
Prosecutors said that Whilby admitted to having as many as eight vodka tonics during a private dinner before continuing the party at a downtown hotel. Police found him at the scene “despondent” and told cops “just let me die” at Bellevue Hospital. His blood alcohol was .22 – almost triple the legal limit, said Clarke.
Whilby’s social media feeds portray him as a “free spirited wild child.” “I’m a smoker, religious stoner…” Whilby captioned on one of his Instagram photos.
A judge ordered him to be held without bond against pleas from Harvey Slovis, Whilby’s lawyer.
If convicted, he could face a maximum of life in prison.
